Pulse Terms.

This is a translation for convenience. The binding version is the Polish Regulamin.

1. General

1. These Terms govern the use of the Pulse website available at pulseaktien.com (the “Service”).
2. Contact with the operator of the Service (the “Provider”): support@pulseaktien.com.
3. Using the Service requires an account and acceptance of these Terms and the risk statement.
4. The basic features of the Service are free. The optional Pulse Pro subscription is paid (section 8).

2. Definitions

• User – an adult using the Service with an account.
• AI Content – rankings, entry and exit price levels, “chance of profit”, reasoning, model debates and any other content generated automatically by artificial intelligence models.
• Account – the User’s personal account, protected by a password and two-step verification.

3. What Pulse is

1. The Service is informational and educational only. It shows how AI models analyse market data.
2. AI Content does not constitute an investment recommendation within the meaning of Regulation (EU) No 596/2014 (MAR), investment advice, a brokerage service or an offer under financial instruments law, nor legal or tax advice.
3. AI Content does not encourage buying, selling or holding any financial instruments. It does not take into account your financial situation, goals or risk tolerance.
4. The Provider is not an investment firm and is not authorised by the Polish Financial Supervision Authority (KNF) to provide investment services.
5. AI Content is generated automatically, without human review. It may be incomplete, outdated or wrong.
6. Market prices come from publicly available third-party sources (currently Yahoo Finance). They may be delayed, incomplete or incorrect. When the source is unavailable, the ranking is switched off. The Provider is not responsible for the accuracy of third-party data.

4. Risk

1. Investing in financial markets carries high risk, including the risk of losing part or all of the money invested.
2. The “chance of profit” and the entry and exit prices are estimates by AI models only, not a promise or guarantee of any result. Past performance does not guarantee future results.
3. You make all investment decisions yourself, at your own risk and responsibility. Consider consulting a licensed adviser before making a decision.

5. Account

1. Only persons aged 18 or over with full legal capacity may create an account.
2. An email address, a password and an authenticator app are required. Two-step verification is mandatory.
3. The User receives one-time backup codes and should keep them safe. Losing both the phone and the backup codes may make the account inaccessible.
4. The User is responsible for keeping the password and codes secret. Accounts must not be shared.
5. The User may request deletion of the account at any time by writing to support@pulseaktien.com.

6. Acceptable use

In particular, it is prohibited to:

• automatically download content (scraping, bots) or circumvent the Service’s limits,
• attempt unauthorised access, disrupt or overload the Service,
• resell or publicly distribute AI Content as investment recommendations,
• use someone else’s data or create accounts on behalf of others.

If these Terms are breached, the Provider may block or delete the account.

7. Liability

1. The Service is provided free of charge, “as is”. The Provider does not guarantee uninterrupted operation, accuracy or fitness of AI Content for any purpose.
2. To the fullest extent permitted by law, the Provider is not liable for damages resulting from decisions made on the basis of AI Content, including financial losses and lost profits.
3. The Provider may temporarily switch off the Service or parts of it, e.g. for maintenance or due to AI provider limits.
4. Nothing in these Terms excludes or limits rights that consumers have under mandatory law.

8. Pulse Pro (paid subscription)

1. Pulse Pro is a paid subscription that includes a private AI agent reviewing the stocks entered by the User, alerts from the agent and using the Service without ads.
2. The price is shown in the Service before purchase and includes taxes. The subscription renews automatically every month until the User cancels it.
3. Payments are handled by Stripe Payments Europe Ltd. The Provider does not receive or store card details.
4. The User can cancel at any time with the “Manage subscription” button. Pulse Pro then stays active until the end of the paid period. Deleting the account ends the subscription.
5. Consumers may withdraw from the contract within 14 days of purchase without giving a reason by writing to support@pulseaktien.com. If they asked for the service to start before that period ended, they pay for the time until withdrawal and the rest is refunded.
6. The Pulse Pro agent is an AI model. Its assessments (“hold”, “take profit”, “consider selling”, “consider adding”), sell targets and protective levels are AI Content within the meaning of section 3 — they are not a recommendation or investment advice and do not take the User’s whole financial situation into account. Sections 3, 4 and 7 apply in full.
7. Complaints about Pulse Pro can be sent to support@pulseaktien.com. We reply within 14 days.

9. Privacy and cookies

1. The data controller is the Provider. For anything about your personal data, write to support@pulseaktien.com.
2. We process: email address, a hash of the password, the two-step verification secret, hashes of backup codes, the account creation date and the date and version of the accepted Terms. We do not store your password in plain text.
3. We process this data to create and run the account and to keep it secure (Art. 6(1)(b) and (f) GDPR), until the account is deleted.
4. If you use the chat, we store your list of friends and invites and the content of messages (including shared stocks) in order to deliver them. Only you and your friend can see the messages. Removing a friend deletes the conversation; deleting your account deletes all your conversations.
5. If you turn on notifications, we store your device’s technical push address (the browser push subscription) and your settings in order to send alerts about watched stocks. Notifications travel through the push service of your browser vendor (e.g. Apple, Google, Mozilla). You can turn them off at any time in Pulse or phone settings.
6. If you add a profile photo, we store it (resized to 256×256 px) until you remove it or delete your account. Only you and your accepted friends can see it.
7. The Service uses a strictly necessary session cookie (sign-in). Public pages show Google AdSense ads: Google Ireland Ltd. may use cookies and similar technologies to show and measure ads, including personalised ones — only with your consent given in the consent dialog. You can change your consent at any time. More: how Google uses data in ads. Pulse’s own visit statistics don’t use cookies.
8. We keep anonymous visit statistics (number of visits, country, page viewed) to improve the Service (Art. 6(1)(f) GDPR). No cookies are used for this and no IP addresses are stored — a visitor is recognised only by a hash created for a single day and deleted after 2 days.
9. If you use Pulse Pro, we store the stocks you enter (symbol, quantity, buy price) and the agent’s latest review until you remove them or delete your account. Symbols and quantities (without your email) are sent to the AI model (Groq, Inc.) so the agent can assess them. Payment and billing data are processed by Stripe; we only store the customer ID and subscription status (Art. 6(1)(b) and (c) GDPR).
10. Data is stored with the infrastructure provider Cloudflare, Inc. AI models (Groq, Inc.) never receive your email or other contact details.
11. You have the right to access, rectify, erase, restrict, port and object to the processing of your data, and to lodge a complaint with the President of the Polish Personal Data Protection Office (PUODO).

10. Changes to the Terms

The Provider may change these Terms for important reasons, e.g. changes in law or in the Service’s features. We will announce changes in the Service. Continued use requires accepting the new version.

11. Final provisions

Polish law applies to matters not covered by these Terms. Consumers may use out-of-court dispute resolution and the European Commission’s ODR platform.
